Ben is kind of implying Congress's power to overturn a decision with 2/3 majority vote.
He wants a higher degree of agreement than 50/50 contestation.

In statistics, 5% is often the minimum for something to be significant. So a 53% to 47% at least would likely convince me that (assuming everyone was well informed and of equal rationale) there is some credence to the vote
